Privacy policy

Welcome to Racing-Total / Heyman-Tours and our website. We are pleased that our services have attracted your interest. Protecting your privacy and personal data is very important to us. We therefore always collect and use your data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the applicable provisions. Below, we, as the controller responsible for data processing, explain which data we collect and how we process it.

1. Personal data

Personal data within the meaning of the GDPR is any information relating to an identified or identifiable natural person. An identifiable natural person is someone who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to that person’s physical, physiological, genetic, mental, economic, cultural or social identity. Personal data is stored only to the extent necessary to provide the booked service, comply with legal requirements or fulfil the purposes stated below.

2. Anonymised data / log files / IP address

You can visit our website without personal data having to be collected. Nevertheless, certain anonymised data is stored each time you visit, for example which page or offer was accessed. This data is not personal data and is therefore not subject to the provisions of the GDPR.

The website operator or hosting provider collects data about access to the site and stores it in “server log files”. The following data is logged: the website visited, the time of access, the amount of data sent in bytes, the source or referring page from which you reached the site, the browser used, the operating system used and the IP address used.

The collected data is used solely for statistical analysis and to improve the website. However, the website operator reserves the right to review the server log files retrospectively if there are specific indications of unlawful use.

Anonymous data is collected solely for statistical analysis to improve our services. Please also refer to the section “Right of access / right to withdraw consent”.

3. Purpose of collecting personal data

Collecting personal data becomes necessary if you wish to book travel or other services through our website, contact us, subscribe to our newsletter, or use other website services that require personal data to be provided. These include, in particular, managing your data in a personal customer area with a login function, purchasing vouchers, entering competitions, or changing existing bookings or orders.

In accordance with the legal provisions, we generally collect only the data needed to provide the particular service you have requested. Where our forms ask for further information, providing it is always voluntary and is identified as such.

The system needs to store the IP address temporarily so that the website can be delivered to the user’s computer. The user’s IP address must therefore remain stored for the duration of the session. Data is also stored in log files to ensure that the website functions properly. We also use this data to optimise the website and ensure the security of our information technology systems. The data is not analysed for marketing purposes in this context. These purposes also constitute our legitimate interest in processing the data under Article 6(1)(f) GDPR.

When travel or other services are booked, the data collected is used to process the booking and, within the limits permitted by law, for advertising and statistical purposes.

The legal basis for sending newsletters and advertising by email following the sale of goods or services is section 7(3) of the German Act Against Unfair Competition (UWG).

If you subscribe to our newsletter, we also store and use the information about you, your orders and your travel services that you provided when booking or registering, on the basis of Article 6(1)(f) GDPR, so that we can provide you with the best possible service as a newsletter subscriber.

Where the user has given consent, the legal basis for processing data after the user subscribes to the newsletter is Article 6(1)(a) GDPR.

We also use the personal data we store to maintain customer relationships, provide customer support (for example, information about the arrangements for your stay), carry out our own advertising and marketing activities (for example, sending catalogues and other advertising materials within the limits permitted by law, and customer satisfaction enquiries), and process orders.

4. Legal basis for processing personal data

Where we obtain the data subject’s consent to process personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) provides the legal basis.

Where personal data is processed as necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) GDPR provides the legal basis. This also applies to processing necessary to take steps before entering into a contract.

Where processing personal data is necessary to comply with a legal obligation to which our company is subject, Article 6(1)(c) GDPR provides the legal basis.

Where the vital interests of the data subject or another natural person make it necessary to process personal data, Article 6(1)(d) GDPR provides the legal basis.

Where processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override that interest, Article 6(1)(f) GDPR provides the legal basis.

5. Disclosure of personal data to third parties

Your personal data is disclosed only in accordance with the applicable provisions, in particular those relating to data protection and competition law.

Where necessary to provide the contractual service we owe or to fulfil legal obligations, your data may also be passed to subcontractors or service providers that provide services in our name or on our behalf, such as technical handling of postal and email communications, payment processing or customer service.

Data is also passed to persons or companies involved in processing your order or booking. For travel services, these include airlines, tour operators, hotels, travel agencies, local destination agencies, car rental companies, cruise companies and authorities. Please note that the data protection provisions applicable where these persons and companies are based may differ from those in Germany.

Your data may also be disclosed and transferred to third parties where we are required to do so by law or by a final court decision.

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided.

6. Storage and deletion of data

Your personal data is stored for the purposes described under “Purpose of collecting personal data”. The data subject’s personal data is deleted or blocked as soon as the purpose of storage no longer applies. Data may also be stored where this is provided for by European or national legislation in EU regulations, laws or other provisions to which the controller is subject. Legislation establishes various retention obligations and periods. Data is also blocked or deleted when a retention period prescribed by these rules expires, unless continued storage is necessary to conclude or perform a contract.

7. Use of cookies

We use cookies, which are small computer files containing text information sent by the web server to your browser, to improve your experience when using our online services. For example, some notices appear only once if you allow us to set a cookie. Our cookies also have an expiry date. If you manually delete cookies before they expire, a new cookie will be set the next time you visit, unless you block cookies from being stored.

The technical specifications provide that a cookie can be read only by the server that sent it. We assure you that we do not store personal data in cookies.

Unfortunately, our services can be used only to a limited extent without accepting cookies. We therefore recommend enabling cookies permanently for our website. Most browsers are set to accept cookies automatically. However, you can disable the storage of cookies and configure your browser to notify you whenever cookies are sent.

The legal basis for processing personal data using cookies is Article 6(1)(f) GDPR.

Where the user has given the relevant consent, the legal basis for processing personal data using cookies for analytical purposes is Article 6(1)(a) GDPR.

8. Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies”, text files stored on your computer that enable analysis of your use of the website. The information generated by the cookie about your use of this website, including your IP address, is transmitted to and stored on a Google server in the USA. Google uses this information to analyse your use of the website, compile reports on website activity for website operators, and provide other services relating to website and internet use. Google may also transfer this information to third parties where required by law or where third parties process the data on Google’s behalf. Google will never associate your IP address with other data held by Google. You can prevent cookies from being installed by selecting the appropriate settings in your browser software. However, please note that this may prevent you from using all the functions of this website in full. By using this website, you consent to Google processing the data collected about you in the manner and for the purposes described above.

The Google tracking codes on this website use the “_anonymizeIp()” function, so IP addresses are processed only in shortened form to prevent direct identification of individuals. You may object to the collection and storage of data at any time with effect for the future. Clicking the “Deactivate” button prevents tracking completely. To make your objection permanent, the browser used must accept cookies. Alternatively, you can object to data collection by using a Google browser plugin to prevent the information collected by cookies, including your IP address, from being sent to and used by Google Inc. The following link takes you to the relevant plugin: https://tools.google.com/dlpage/gaoptout?hl=en.

9. Facebook social plugins

This website uses social plugins (“plugins”) from the social network facebook.com, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins can be recognised by a Facebook logo, such as a white “f” on a blue tile or a “thumbs up” symbol, or by the words “Facebook Social Plugin”. A list of Facebook social plugins and their appearance can be found at http://developers.facebook.com/plugins.

When a page on this website containing such a plugin is accessed, the browser connects directly to Facebook’s servers. Facebook transmits the plugin’s content directly to the browser, which incorporates it into the page. We therefore have no influence over the amount of data Facebook collects using this plugin and provide the following information to the best of our knowledge: integrating the plugins allows Facebook to receive information that the relevant page of our website has been accessed. If you are logged into Facebook, Facebook can associate your visit with your Facebook account. If you interact with the plugins, for example by clicking the “Like” button or posting a comment, the relevant information is sent directly from your browser to Facebook and stored there. Even if you are not a Facebook member, Facebook may still be able to obtain and store your IP address. For details of the purpose and extent of data collection, the further processing and use of data by Facebook, and your rights and settings to protect your privacy, please refer to Facebook’s privacy policy at http://www.facebook.com/policy.php. If you are a Facebook member and do not want Facebook to collect data about you through our website and link it to your membership data stored by Facebook, you must log out of Facebook before visiting this website. Facebook social plugins can also be blocked using browser add-ons, such as “Facebook Blocker”.

10. YouTube

This website uses a link to YouTube, a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When embedding videos, we use “privacy-enhanced mode”, so information about your use is transmitted only when you start the video. In that case, information is transmitted about the specific page you visited on our website and the video you watched. If you are logged into your YouTube account, you enable YouTube to associate your page visits directly with your personal profile. Further information about the collection and processing of your data by YouTube can be found in the relevant privacy information at www.youtube.com.

If you want to ensure that YouTube does not store any data about you, do not click on the embedded videos.

11. Right of access / right to withdraw consent; further rights of data subjects

You have the following rights:

  • Under Article 15 GDPR, you may request information about your personal data that we process. In particular, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the envisaged retention period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data if it was not collected by us, and the existence of automated decision-making, including profiling, and, where applicable, meaningful information about its details.
  • Under Article 16 GDPR, you may request the rectification of inaccurate personal data or completion of your personal data stored by us without undue delay.
  • Under Article 17 GDPR, you may request the erasure of your personal data stored by us, unless processing is necessary to exercise the right to freedom of expression and information, comply with a legal obligation, fulfil reasons of public interest, or establish, exercise or defend legal claims.
  • Under Article 18 GDPR, you may request restriction of the processing of your personal data if you contest its accuracy, if processing is unlawful but you oppose its erasure, if we no longer need the data but you require it to establish, exercise or defend legal claims, or if you have objected to processing under Article 21 GDPR.
  • Under Article 20 GDPR, you may receive the personal data you have provided to us in a structured, commonly used and machine-readable format or request its transmission to another controller.
  • Under Article 7(3) GDPR, you may withdraw your consent at any time by notifying us. This means that we may no longer continue the data processing based on that consent for the future.
  • Under Article 77 GDPR, you may lodge a complaint with a supervisory authority. As a rule, you may contact the supervisory authority for your usual place of residence, your workplace or our company’s registered office.

12. Security, questions and suggestions, controller

Security also depends on your own system. You should always keep your login details confidential, never allow your web browser to save passwords, and close the browser window when you finish visiting our website. This makes it more difficult for third parties to access your personal data.
